Divebuddyping user rules
Welcome to Divebuddyping. Before you create an account and start looking for a diving buddy, we ask you to agree to our basic rules. Together we keep Divebuddyping safe and enjoyable.
1. Your account and diving license
You fill in your details truthfully. Your account is personal. Divebuddyping is exclusively intended for persons aged 18 or older who are certified recreational divers. By creating an account you declare that you are at least 18 years old and that you have a valid diving license. Divebuddyping does not check your age or certification. Always check the certification, experience and suitability of your buddy before the dive.
2. Behavior and moderation
We treat each other with respect and sportiness. Hurtful, discriminatory, threatening, misleading or intimidating messages and comments are prohibited. Spam, unwanted advertising and promotion of unsafe or illegal diving behavior are prohibited. Do not share personal information or images of others without permission. Divebuddyping may delete messages and comments and limit or block accounts for violations. Divebuddyping is exclusively intended for establishing contacts between recreational divers. It is not permitted to use the platform for commercial activities, advertising, sale, acquisition or promotion of products, services or events without prior written permission from Divebuddyping.
3. Safety and own risk
Divebuddyping is free and only offers an online meeting place. Divebuddyping does not organize dives itself. You dive entirely at your own responsibility and risk. Check equipment, certification, experience, conditions and the dive plan. Always carry out a careful buddy check. Respect local nature, access and safety rules. You may always refuse, cancel or abort a dive.
4. Calls and responses
Only place genuine and correct calls. Only respond if you are actually interested. Withdraw a call in a timely manner if it does not go through. After withdrawal, no further response can be made. A revoked or expired call may remain in the personal history of affected Users.
1. Definitions
Divebuddyping: the website, the PWA/app and all associated services. User: any natural person who creates an account with Divebuddyping. Dive buddy: two or more Users who contact each other via Divebuddyping to dive together. Call: an invitation placed by a User to dive together on a specific date, time and location. Organizer: the User who places a Call. Content: all texts, calls, responses, profile information and images posted by Users.
2. Applicability and free service
These conditions apply to all use of Divebuddyping. Upon registration the User agrees to this. Basic use is completely free. Divebuddyping may introduce additional paid options later; costs and conditions are clearly communicated in advance. The account is personal. The User is responsible for his own login details and use of the account.
3. Nature of service – no party
Divebuddyping is exclusively an online meeting place for people aged 18 or older who have a valid diving license and does not organize diving trips, dives, courses or events itself. Calls are placed by Users. The Organizer does not act on behalf of Divebuddyping. Divebuddyping is not a party to agreements between Users. Users make their own agreements about date, time, location, diving plan, transport, costs and other practical matters.
4. Diving certification and user obligations
Divebuddyping is exclusively intended for persons aged 18 or older who are certified recreational divers. By creating an account, the User declares to be at least 18 years old and to be in possession of a valid diving license. Divebuddyping does not check whether a user is actually 18 years or older, nor does it check the presence, validity, issuing organization or level of a diving certificate. Divebuddyping does not guarantee stated certifications or experience. Users check each other's certification, experience and suitability for the planned dive in advance and keep their data true and up to date.
5. Calls, responses and retractions
The Organizer is responsible for date, time, location and description. Comments must be relevant; final agreements are made mutually. A future Call may be withdrawn. Afterwards, new responses are blocked, while existing responses can remain visible as a historical context. Revoked and expired Calls may appear in the personal history of affected Users. In the event of revocation, set email or push notifications can be sent; on-time delivery is not guaranteed.
6. Rules of conduct and moderation
Users communicate respectfully, constructively and sportily. Content that is unlawful, dangerous, abusive, discriminatory, defamatory, threatening, harassing, sexually offensive, spam, misleading, unsolicited commercial advertising, unauthorized personal data, malware, phishing or rights infringement is prohibited. Divebuddyping may hide or remove such Content and, depending on the severity, warn, limit functions or temporarily block or permanently terminate an account. In the event of serious violations, immediate action can be taken. Divebuddyping is exclusively intended for establishing contacts between recreational divers. It is not permitted to use the platform for commercial activities, advertising, sale, acquisition or promotion of products, services or events without prior written permission from Divebuddyping.
7. Safety and own risk
Every User dives entirely at his or her own responsibility and risk, makes an appropriate diving plan and carries out a careful buddy check before each dive. Users provide suitable equipment, assess medical and physical suitability and check buddy, local rules, weather, current, tide, visibility, temperature and other risks. Any User may refuse, cancel or abort a dive. Information on Divebuddyping does not replace training, briefing or local safety information.
8. Liability
Divebuddyping is not an organizer or operator and is not responsible for actions or omissions of Users. No guarantee is given regarding information, certifications, experience, conditions or materials. To the extent permitted by law, Divebuddyping is not liable for damage, loss, injury, indirect damage, consequential damage, missed appointments or loss of Content from appointments or diving. This does not apply where exclusion is prohibited by law, including intent or deliberate recklessness on the part of Divebuddyping. Mutual disputes are resolved by Users.
9. Content and rights
The User remains responsible for his own Content and declares that he has the necessary rights. Divebuddyping is only granted the limited, non-exclusive right to store, technically process and display Content for the service to authorized Users. Copyright is not transferred. The right of use ends upon deletion, except where temporary technical, legal or backup storage is necessary.
10. Availability and technical operation
Divebuddyping strives for reliable operation but does not guarantee uninterrupted or error-free availability. Maintenance, disruptions and changes may limit the service. Divebuddyping is not responsible for problems with browsers, operating systems, internet connections, email providers or push providers. Users store information themselves that they need outside the service.
11. Account termination
The User can request account deletion via the contact address. Divebuddyping may limit or terminate accounts in case of violation, abuse or security risks. The Privacy Statement describes implications for data and historical Content. Data does not necessarily disappear immediately from every backup or security log.
12. Changes
Divebuddyping may change these conditions. The current version states version and modification date. Substantial changes are communicated via app, website or email. If new approval is required, this will be explicitly requested.
13. Governing Law and Disputes
Dutch law applies. Mandatory consumer rights continue to apply. Users can contact us first for a practical solution. Disputes will be submitted to the competent court in accordance with the applicable legal rules.
